Terms of service

§ 1 General – Scope

  1. These General Terms and Conditions (T&C) apply to all orders and contractual relationships between horntools International GmbH, Grabenstrasse 11D, 6340 Baar, Switzerland – hereinafter referred to as "horntools" – and its customers via the online shop horntools.ch. The version valid at the time the contract is concluded shall apply.
  2. Consumers are natural persons who purchase goods predominantly for private purposes. Businesses are natural or legal persons or partnerships acting in the course of their commercial or professional activity when concluding the contract.
  3. Deviating, conflicting or supplementary terms and conditions of the customer shall only become part of the contract if horntools has expressly agreed to their validity.
  4. By placing an order, the customer agrees to these T&C, provided they were made reasonably accessible to the customer before the order was completed.

§ 2 Conclusion of the Contract

  1. The presentation of products in the online shop serves to present our range and does not constitute a binding offer.
  2. By submitting the order, the customer makes a binding offer to conclude a purchase contract for the goods in the shopping cart.
  3. Before submitting the order, the customer can review and correct their entries.
  4. Receipt of the order is confirmed electronically without delay. The automatic order confirmation only documents the receipt of the order and does not constitute acceptance of the offer, unless acceptance is expressly declared therein.
  5. The contract is concluded as soon as horntools expressly confirms the order, sends a shipping confirmation or ships the ordered goods.
  6. horntools is entitled to reject an order, in particular if the goods are unavailable, in the case of obviously incorrect prices, justified suspicion of misuse or failed payment processing.
  7. Payments already made will be refunded if the order is rejected or the goods are unavailable.
  8. horntools may limit order quantities to normal household quantities.
  9. The contract text and order data are stored within the scope of legal and technical possibilities. The customer receives the essential order data by email.

§ 3 Contract Language

The online shop and contract information may be provided in several languages. The version used during the ordering process shall generally prevail. In the event of discrepancies between translations, the German version serves as the reference, insofar as legally permissible.

§ 4 Retention of Title

Insofar as legally permissible, the delivered goods remain the property of horntools until all claims arising from the respective purchase contract have been paid in full. Where registration in a public register is required under Swiss law for a retention of title to be effective, such registration is reserved.

Businesses may only resell goods subject to retention of title in the ordinary course of business.

§ 5 Voluntary Right of Return

horntools voluntarily grants private end consumers a 14-day right of return.

Details, conditions, exclusions and information on return costs are set out in our Return Policy.

The voluntary right of return is separate from statutory claims for defective or faulty goods and does not limit them.

§ 6 Prices and Payment

  1. Prices shown in the online shop for consumers are in Swiss francs (CHF) and include statutory public charges and Swiss VAT, where applicable.
  2. Additional shipping costs are clearly displayed before the order is completed.
  3. For deliveries within Switzerland via horntools.ch, the shipping and customs conditions shown in the checkout and in the shipping policy apply.
  4. The total price shown in the checkout at the time of the order applies to the respective order. Later price changes do not affect contracts already concluded.
  5. Depending on availability, the following payment methods may be offered in particular:
    • Credit card (Visa, Mastercard)
    • TWINT
    • Prepayment
    • PayPal
    • Google Pay
The currently available payment methods are shown in the checkout.
  6. For payment by bank transfer, the invoice amount must be transferred within the period stated in the order or payment information. The date of receipt of payment by horntools is decisive.
  7. If the customer is in default with a monetary claim due, horntools may charge the statutory default interest of 5% per year, unless otherwise validly agreed.
  8. Necessary and reasonable costs of legal enforcement or debt collection may be charged to the customer to the extent permitted by law.

§ 7 Delivery

  1. Delivery is carried out by a shipping or logistics provider selected by horntools.
  2. The current shipping conditions of horntools.ch apply.
  3. For products in stock, the regular delivery time within Switzerland is generally 4–10 working days, unless a different delivery time is stated on the product page or during the ordering process.
  4. Different delivery times may apply to pre-orders, items not in stock, custom-made products or freight goods. The information on the product page or the individually communicated delivery information shall apply.
  5. If a delivery is delayed for reasons beyond the control of horntools, in particular due to force majeure, supply shortages or delays by transport providers, the customer will be informed as far as possible.
  6. For consumers, the risk of accidental loss or accidental deterioration generally passes upon handover of the goods to the customer or a recipient designated by them.
  7. For businesses, the risk passes, insofar as legally permissible, upon handover of the goods to the forwarder, carrier or other transport provider.
  8. If packaging is visibly damaged upon delivery, we ask you to document the damage directly with the transport provider where possible and to inform horntools promptly. The customer's statutory rights are not excluded if they fail to report the damage to the transport provider.

§ 8 Warranty and Voluntary Guarantee

1. Statutory Warranty

The provisions of the Swiss Code of Obligations (CO) apply to defects in the delivered goods, unless validly agreed otherwise below.

Consumer claims for material defects generally become time-barred two years after delivery of the goods, unless a longer period has been promised or mandatory statutory provisions provide otherwise.

In the case of a justified defect, horntools may in particular offer a repair or replacement. Further statutory rights of the customer remain unaffected.

2. Businesses

Businesses must inspect the goods upon receipt in the ordinary course of business and report any recognisable defects as soon as possible. Hidden defects must be reported immediately after discovery.

The warranty period for businesses is, insofar as legally permissible, one year from delivery of the goods.

3. Voluntary horntools Guarantee

In addition to the statutory warranty rights, horntools grants consumers a voluntary guarantee for certain product groups:

  • Roof top tents: 5 years
  • Roof racks: 5 years
  • Winches: 5 years
  • All other products: 2 years, unless a different guarantee is stated for the respective product

The voluntary guarantee begins on the purchase date stated on the invoice. It supplements the statutory warranty rights and does not limit them.

The guarantee requires proper use of the product in accordance with the operating and installation instructions and compliance with the specified maintenance and inspection intervals.

4. Transferability of the Guarantee

The voluntary guarantee applies exclusively to the first purchaser and is not transferable to third parties. The statutory warranty rights remain unaffected.

5. Guarantee Exclusions

The voluntary guarantee excludes in particular damage or defects caused by:

  • normal wear and tear or natural ageing of wear parts;
  • improper use, overloading or incorrect operation;
  • installation or use deviating from the installation or operating instructions;
  • unauthorised modifications, repairs or interventions;
  • use of unsuitable accessories or spare parts, if these caused the damage;
  • accidents, external force, lack of maintenance or improper storage;
  • natural events or other external influences not attributable to a product defect.

6. Making a Guarantee Claim

To report a guarantee or warranty claim, please contact info@horntools.com.

Please include your order or invoice number and a description of the defect that is as precise as possible. Photos or videos can speed up processing.

Goods should only be returned after consultation with horntools. The return address will be provided during processing. Here too: returns must be sent exclusively to horntools International GmbH (see § 9).

Suitable proof of purchase is required for a guarantee claim. Repair or replacement does not restart the original guarantee period, unless expressly promised otherwise.

§ 9 Voluntary Right of Return for Consumers

Consumers can make use of our voluntary right of return within 14 days of receiving the goods.

The goods may generally be unpacked and inspected to the extent that would be possible in a shop. Any use, installation or commissioning beyond this may exclude the return or lead to an appropriate deduction from the refund.

The customer bears the direct costs of the return.

Registration and Return Address

Returns must be registered in advance by email to info@horntools.com. You will then receive the return address and all information about the return.

Returns must be sent exclusively to horntools International GmbH – not to horntools GmbH in Austria.

horntools GmbH cannot accept returns from Switzerland unless they have been customs-cleared in advance by the customer. Any resulting costs and delays are borne by the customer.

All details on the voluntary right of return, in particular on deadlines, condition of the goods, original packaging, refunds and exclusions, are set out in our Return Policy.

§ 10 Liability

  1. horntools is liable in accordance with mandatory statutory provisions.
  2. Liability for damage caused intentionally or through gross negligence cannot be excluded.
  3. Insofar as legally permissible, horntools' liability for slight negligence and for indirect damage, consequential damage, lost profits or unrealised savings is excluded. Mandatory liability provisions, in particular under the Swiss Product Liability Act, remain unaffected.
  4. The customer is obliged to observe product, installation, operating and safety instructions and to use the product exclusively as intended.
  5. Information on vehicle compatibility, load capacity, installation or possible uses is based on the product and vehicle data available at the time. The customer is obliged to independently observe vehicle-specific requirements, permissible roof and axle loads and official regulations in particular.
  6. horntools accepts no responsibility for the content of external websites linked to, unless there is statutory liability.

§ 11 Packaging and Electrical and Electronic Equipment

Packaging

We ask our customers to recycle or reuse packaging material in accordance with local regulations.

Waste Electrical and Electronic Equipment

Waste electrical and electronic equipment must not be disposed of with normal household waste.

Insofar as horntools is obliged to take back such equipment under Swiss regulations, end consumers may return used electrical and electronic equipment of the type horntools carries in its range free of charge. This generally applies regardless of whether a new device is purchased at the same time.

Please contact us before returning at info@horntools.com so that we can tell you the intended return option or return address.

Batteries and accumulators must also be returned or disposed of separately in accordance with applicable Swiss disposal regulations.

Businesses

For deliveries on reusable or Euro pallets, separate agreements on the return or exchange of the pallets may be made.

§ 12 Copyright

  1. Texts, graphics, images, videos, logos, product presentations and other content of the horntools online shop may be protected by copyright or other intellectual property rights.
  2. Any reproduction, editing, distribution, public communication or other use beyond the limits permitted by law requires the prior consent of the respective rights holder.
  3. Product images serve to illustrate the products offered. Minor deviations of the actual product, in particular due to technical developments, production changes or screen display, are reserved, provided they are reasonable for the customer and do not change the essential properties of the product.

§ 13 Customer Reviews

  1. Customers can submit reviews of products purchased from horntools via our review service provider Judge.me.
  2. horntools endeavours to match reviews to actual orders. This may be done in particular by automated comparison with order data.
  3. horntools reserves the right not to publish or to subsequently remove reviews, in particular if they contain offensive, unlawful, obviously off-topic or misleading content, disclose personal data of third parties or cannot plausibly be attributed to an actual product experience.
  4. There is no entitlement to the publication of a review.

§ 14 Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

§ 15 Final Provisions

  1. Contracts with horntools are generally governed by Swiss law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
  2. For consumers, mandatory statutory consumer protection provisions and mandatory statutory places of jurisdiction remain unaffected.
  3. For disputes with businesses, the registered office of horntools International GmbH in Baar, Canton of Zug, Switzerland is agreed as the exclusive place of jurisdiction, insofar as legally permissible.
  4. For consumers, the places of jurisdiction provided by law apply.
  5. Should any provision of these T&C be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provisions.
